PixLingo Terms of Service
Welcome to PixLingo! These Terms of Service (“Terms”) govern your access to and use of the PixLingo mobile application, website, and related services (collectively, the “Service”) provided by DermatoGraphix LLC (“PixLingo,” “we,” “us,” or “our”).
By creating an account, downloading the app, subscribing to Premium, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of the Service
PixLingo is a visual mnemonic language learning platform that helps users learn languages using images, symbols, memory techniques, spaced repetition, and AI-generated content. The Service includes both free and Premium features.
2. Eligibility
You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service. If you are under 18, you must have parental or guardian consent.
3. User Accounts
- You must create an account to access most features of the Service.
- You are responsible for keeping your account information accurate and secure.
- You may not share your account or login credentials with others.
- We reserve the right to suspend or terminate accounts that violate these Terms or appear to be inactive for an extended period.
4. Subscriptions and Payments
- PixLingo offers a free version and a paid Premium subscription.
- Premium subscriptions automatically renew at the end of each billing period unless canceled.
- All payments are processed through the Apple App Store or Google Play Store.
- Fees are non-refundable except where required by law.
- We may change subscription prices with reasonable notice. Price changes will apply at the start of the next billing cycle.
5. User Content
You may create and share custom mnemonics, notes, or other content (“User Content”).
- You retain ownership of your User Content.
- By uploading or creating User Content, you grant DermatoGraphix LLC a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content in connection with the Service.
- You are solely responsible for your User Content and must ensure it does not violate any laws or third-party rights.
6. Prohibited Uses
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Copy, modify, distribute, or create derivative works of our content without permission
- Reverse engineer, decompile, or attempt to extract the source code of the app
- Harass, abuse, or harm other users
- Upload content that is offensive, misleading, or infringing
- Use bots, scrapers, or automated tools to access the Service
- Share Premium access or attempt to circumvent payment
7. Intellectual Property
All content, designs, mnemonics, software, trademarks, and materials in the Service are owned by DermatoGraphix LLC or its licensors. You may not use our intellectual property without prior written permission.
8. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ends immediately.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that the learning methods will work equally well for everyone.
Language learning outcomes vary by individual. PixLingo is a learning tool and does not guarantee fluency or specific results.
10. Limitation of Liability
To the fullest extent permitted by law, DermatoGraphix LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
11. Indemnification
You agree to indemnify and hold harmless DermatoGraphix LLC and its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law principles.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the app, email, or website. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
